m\u00e9moire, on rappellera qu\u2019aux termes de l\u2019<em>article L. 4622-9-1<\/em> du code du travail, tel qu\u2019issu de la <em>loi n\u00b02021-1018<\/em> du 2 ao\u00fbt 2021, chaque SPSTI \u00ab\u00a0fournit \u00e0 ses entreprises adh\u00e9rentes et \u00e0 leurs travailleurs\u00a0un ensemble socle de services\u00a0qui\u00a0doit couvrir l\u2019int\u00e9gralit\u00e9 des missions\u00a0pr\u00e9vues \u00e0 l<em>\u2019article L.4622-2<\/em> en mati\u00e8re de pr\u00e9vention des risques professionnels, de suivi individuel des travailleurs et de pr\u00e9vention de la d\u00e9sinsertion professionnelle\u00a0\u00bb, dont la liste et les modalit\u00e9s sont d\u00e9finis par le CNPST et approuv\u00e9 par voie r\u00e9glementaire.<\/h4>\n<p style=\"text-align: justify;\">C\u2019est dans ce cadre que le <em>D\u00e9cret n\u00b02022-653<\/em> du 25 avril 2022 a \u00e9t\u00e9 publi\u00e9 au JO du 26 avril 2022:<\/p>\n<h5 style=\"text-align: justify;\"><span style=\"color: #009db2;\"><a style=\"color: #009db2;\" href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000045653570\"><em>D\u00e9cret n\u00b0 2022-653 du 25 avril 2022 relatif \u00e0 l\u2019approbation de la liste et des modalit\u00e9s de l\u2019ensemble socle de services des services de pr\u00e9vention et de sant\u00e9 au travail interentreprises \u2013 L\u00e9gifrance (legifrance.gouv.fr)<\/em><\/a><\/span><\/h5>\n<p style=\"text-align: justify;\">Il n\u2019y aura donc pas de D\u00e9cret en Conseil d\u2019Etat, lequel \u00e9tait envisag\u00e9 par la loi pr\u00e9cit\u00e9e uniquement par d\u00e9faut.<\/p>\n<p style=\"text-align: justify;\">Ceci pos\u00e9, on rel\u00e8vera que ce D\u00e9cret, en vigueur \u00e0 compter du 27 avril 2022, porte approbation de la d\u00e9lib\u00e9ration du <strong>CNPST<\/strong>, relative \u00e0 la liste et aux modalit\u00e9s de l\u2019ensemble socle des services \u00e0 fournir, laquelle d\u00e9lib\u00e9ration en constitue l\u2019annexe.<\/p>\n<p style=\"text-align: justify;\">Pour autant, dans la mesure o\u00f9 cette m\u00eame d\u00e9lib\u00e9ration du <strong>CNPST<\/strong> porte sur des sujets distincts de cet ensemble socle, l\u2019<em>article 1er<\/em>\u00a0exclut de cette approbation une liste de points.<\/p>\n<p style=\"text-align: justify;\">En d\u2019autres termes, ce D\u00e9cret approuve la d\u00e9lib\u00e9ration du <strong>CNPST<\/strong> portant liste et modalit\u00e9s de l\u2019ensemble socle pr\u00e9vu \u00e0 l\u2019<em>article L4622-9-1<\/em>, mais n\u2019approuve pas les points de cette m\u00eame d\u00e9lib\u00e9ration qui concernent\u00a0d\u2019autres sujets, que sont :<\/p>\n<ul style=\"list-style-type: circle;\">\n<li>L\u2019offre de services\u00a0compl\u00e9mentaires, d\u00e9termin\u00e9e par le SPSTI,<\/li>\n<li>L\u2019offre sp\u00e9cifique de services pr\u00e9vue \u00e0 l<em>\u2019article L4621-3<\/em> du code du travail (d\u00e9di\u00e9e aux travailleurs ind\u00e9pendants), qui rel\u00e8vera d\u2019un D\u00e9cret \u00e0 part enti\u00e8re,<\/li>\n<li>Les comp\u00e9tences des membres de l\u2019\u00e9quipe pluridisciplinaire, (la comp\u00e9tence infirmi\u00e8re doit faire l\u2019objet d\u2019un D\u00e9cret en Conseil d\u2019Etat, notamment),<\/li>\n<li>Les conditions dans lesquelles le m\u00e9decin du travail peut d\u00e9l\u00e9guer certaines missions en application de l\u2019<em>article L4622-8<\/em>, lequel renvoie \u00e0 un D\u00e9cret en Conseil d\u2019Etat<\/li>\n<li>L\u2019administration, l\u2019organisation et la gestion des SPSTI relevant de leur Conseil d\u2019Administration et de la Commission de Contr\u00f4le,<\/li>\n<li>Et \u00e0\u00a0l\u2019ensemble des documents\u00a0vis\u00e9s \u00e0 l\u2019<em>article L4622-16-1<\/em>, qui rel\u00e8vent d\u2019un D\u00e9cret \u00e0 part enti\u00e8re.<\/li>\n<\/ul>\n<h4>D\u00e9sormais, chaque service de pr\u00e9vention et de sant\u00e9 au travail devra obligatoirement int\u00e9grer dans ses actions les missions suivantes :<\/h4>\n<ul style=\"list-style-type: circle;\">\n<li>La pr\u00e9vention des risques professionnels, incluant notamment un conseil renforc\u00e9 et l\u2019accompagnement des entreprises dans l\u2019\u00e9laboration de leur document unique d\u2019\u00e9valuation des risques professionnels et la conduite d\u2019action de pr\u00e9vention primaire telles que l\u2019identification et l\u2019am\u00e9nagement des postes \u00e0 risque pour la sant\u00e9 des travailleurs.<\/li>\n<li>Le suivi individuel de l\u2019\u00e9tat de sant\u00e9 de chaque salari\u00e9, tout au long de son activit\u00e9, \u00e0 travers la mise en place de l\u2019ensemble des suivis et visites m\u00e9dicales pr\u00e9vues par la r\u00e9glementation.<\/li>\n<li>La pr\u00e9vention de la d\u00e9sinsertion professionnelle, \u00e0 travers la mise en place et l\u2019animation d\u2019une cellule op\u00e9rationnelle pour accompagner les salari\u00e9s pr\u00e9sentant un risque de sortir de l\u2019emploi en raison de leur \u00e9tat de sant\u00e9.<br \/>\nLa liste d\u00e9taill\u00e9e des missions attendues est d\u00e9crite dans la d\u00e9lib\u00e9ration du CNPST annex\u00e9e au d\u00e9cret.
